Application of GTCs

JDF ARCADE reserves the right to modify the GTC at any time by publishing a new version of the GTC on https://jdfarcade.com/en/. The GTCs applicable to the customer are those in force on the day of his order on https://jdfarcade.com/en/.

Article 1 – Prices and methods of payment

1.1 – Pricing

The prices of the products are shown in euros all taxes included (VAT) excluding shipping costs.

JDF ARCADE reserves the right to change its prices at any time and to pass on, if applicable, any change in the VAT rate in force to the price of the products proposed on the https://jdfarcade.com/en/.

Article 2 – Orders and Payment

2.1 – Customer account

2.2 – Controls

In the case of payment by bank transfer, the delivery times defined in the "Delivery" article of these Terms and Conditions shall not begin to run until the effective date of receipt of the payment by JDF Arcade.

Order forms and invoices will be archived on a reliable and durable medium that is a true copy. Computerised records will be considered by the parties as evidence of communications, orders, payments and transactions between the parties.

2.4 Payment periods

The price is payable in cash, in full on the day of the order.

For orders paid by bank transfer, without receipt of payment within 5 days, the order will be cancelled automatically.

JDF Arcade reserves the right to suspend or cancel any order and/or delivery, whatever its nature and level of execution, in the event of non-payment of any amount due by the customer, or in the event of payment incident.

In case of suspicion of fraud, JDF Arcade reserves the right to request any proof of identity from the client.

Article 3 – Availability

The availability of products is indicated on https://jdfarcade.com/en/, in the descriptive sheet of each Product. In the event of product unavailability after placing the order, the customer will be informed. The order will be automatically cancelled and no bank debit will be made.

Article 4 – Delivery

4.1 – General

The products are delivered to the delivery address that the customer will indicate during the order process, unless delivery restrictions are indicated on the order validation page by the customer. (see delivery conditions)

The customer can also pick up his order free of charge from our premises at: 8bis rue Adélaïde Lahaye 93170, Bagnolet.

4.2 Delivery times

The delivery time shall be:

• the shipping time indicated on the article sheet to which the processing and delivery time is added.

JDF Arcade cannot be responsible for delay in delivery due exclusively to unavailability of the customer.

In the case of multiple orders at the same time and these have different delivery times, the delivery time of the order is based on the earliest delay. JDF Arcade, however, reserves the possibility of splitting shipments. Participation in processing and shipping costs will only be charged for one shipment.

4.2 – Delivery area

JDF Arcade covers the area of France (Hors DOM-TOM), Belgium and Luxembourg.

Article 5 – Errors and delays in delivery

If the customer's package is returned to JDF Arcade by the carrier, JDF Arcade will contact the customer upon receipt of the package in return to ask him to follow up on his order. If the customer has mistakenly refused the package, he will be able to request the return of the parcel by paying the transport costs for the new shipment in advance. Shipping costs will have to be paid even for orders whose shipping costs were offered at the time of the order.

In case of delay in shipping, an email will be sent to the customer to inform him of any consequences on the delivery time indicated.

Article 6 – Receipt

The customer is reminded that when he takes physical possession of the products ordered, the risk of loss or damage to the products is transferred to him.

Therefore, the customer must check the condition of the Product in the presence of the carrier before signing the delivery note:

-Any problem on the delivered product (open, very damaged, broken product, deteriorated in such a place...), must then be indicated by the customer on the delivery note, in the form of handwritten reservations, accompanied by the customer's signature and the rejected package.

– The carrier will have to take over the goods free of charge.

– The customer must notify by email within 24 hours, using our contact form.

A new product will be sent.

Failing to comply with these requirements, the customer will not be able to exercise his right of refusal, and JDF Arcade will not be required to grant the customer's right of refusal.

Article 7 – Order Cancellation

The customer can cancel his order before shipping. The customer should notify JDF Arcade using our contact form. After receipt of the customer's e-mail, the refund of the sums received will take place within a maximum of 14 days.

Article 8 – Right of withdrawal

8.1 Legal time limit for the right of withdrawal

In accordance with the legal provisions in force (Article L.221-18 of the Consumer Code), the customer has 14 days from the date of placing the order to exercise his right of withdrawal without having to justify reasons or pay a penalty.

8.2 – Method of withdrawal

In the event of the exercise of the right of withdrawal within the period referred to above, only the price of the product(s) purchased will be refunded, the shipping costs and the return costs remaining at the customer's expense.

Returns are to be made in their original and complete condition (package, accessories, package insert...) allowing the re-marketing in new condition. This repayment date may be postponed until the product is received.

Return expenses: The customer must contact the carrier of his choice, or ask JDF Arcade to take care of the return. In case JDF Arcade takes care of the return transport, the return costs are indicated to the customer before return.

Article 9 – Guarantee

All our products benefit from the legal guarantee of conformity and the guarantee of hidden defects, provided for in articles 1641 et seq. of the Civil Code.

In the event of non-compliance with a product sold, it may be returned, exchanged or refunded

Computer and electronics are guaranteed two years.

All repairs are to be performed by you with telephone or video assistance (change of new parts sent to the delivery address)

JDF Arcade does not travel to private or professional homes for troubleshooting outside the Ile de France.

This product has a manufacturer's warranty, apart from the following:

– Normal wear: ‘normal wear' includes cosmetic or insignificant deterioration which may occur over time.

– Intake of water, dust, insects in the product.

– Damage due to shock, or overload.

– All fire-related accidents, flooding.

– Damage resulting from lightning or electrical overvoltage.

– The product was examined, dismantled, repaired and/or modified by unauthorized personnel.

– Damage was caused by the use of components not manufactured or sold by JDF Arcade.

Article 10 – Liability

The proposed products comply with the French legislation in force. JDF Arcade cannot be held liable for non-compliance with the legislation of the country where the product is delivered. It is up to the customer to check with the local authorities on the possibility of importing or using the products he intends to order.

The total or partial impossibility of using the products, in particular because of incompatibility of the equipment, cannot give rise to any compensation or reimbursement or liability for JDF Arcade.

JDF Arcade cannot under any circumstances be held liable for damages resulting from improper use of the product by the customer.

JDF Arcade may not be held liable for failure to perform the contract in the event of a stock shortage or unavailability of the product, force majeure, disturbance or total or partial strike by a third party to the contract.

In the event of professional purchases, JDF Arcade shall not incur any liability for any indirect damage caused by the present, loss of exploitation, loss of profit, loss of chance, damage or expense that may arise as a result of the purchase of the products.
